Reconsider Justice KM Joseph’s Appointment, Centre Asks Top Court: Sources

NEW DELHI: The government has sent back the name of Uttarakhand Chief Justice KM Joseph, one of the two judges recommended for promotion to the Supreme Court, urging a panel of five most senior judges to be “objective and fair” and reconsider their decision. Sources say the government has said Justice Joseph’s name was not recommended “in terms of seniority and merit and fair representation”.

Indu Malhotra, the second person recommended by the top judges, was cleared yesterday by the law ministry to be a Supreme Court judge. Both names were recommended together three months ago. The delay in the government’s decision prompted senior judges to write to the Chief Justice expressing concern over interference.
